Surrogacy in Tennessee

Family formation law includes both adoption and Assisted Reproductive Technology (ART).  ART generally refers to fertility treatments, such as intrauterine insemination (IUI) and in-vitro fertilization (IVF).

We frequently represent Intended Parents and Gestational Carriers to draft or review Gestational Surrogacy Agreements. 

TN Requirements of Surrogacy

Prior to drafting your agreement, you’ll need a psychological evaluation, background checks, and medical clearance from the fertility clinic.  We work with agencies and couples on an independent journey.  

The Gestational Carrier does not contribute the egg to the embryo.  Either both Intended Parents contribute genetic material to the embryo, or an anonymously donated egg is used.  Each state handles surrogacy cases differently.

Surrogacy Process TN

In Tennessee, an Order of Parentage “PBO” establishes the legal parent/child relationship between the genetically related parent(s) and the child prior to the child’s birth.  We strive to have the PBO in place well before the baby is born.  If one parent is not genetically related to the baby, we obtain an adoption shortly after the birth to establish the parental relationship and have that parent added to the child’s birth certificate.

Once the PBO has been entered by the court, we contact the hospital and Vital Records to make sure that everything goes smoothly upon the birth.
